Coverage · Where we start
Kyle.
Kyle is a fast-growing city on I-35 between Austin and San Marcos, and the corridor through it is full of industrial, retail and multifamily sites. Inside the city, zoning and site plan rules apply. In the ETJ, the city’s subdivision rules can reach your land.
Who governs what
Several offices hold part of the rulebook.
Which ones apply depends on exactly where the parcel sits. We confirm that first, from the source.
| Who | What they decide |
|---|---|
| City of Kyle Planning | Zoning, site plans, subdivision and plats inside the city, and subdivision rules in the ETJ. |
| Planning and Zoning Commission and City Council | Zoning changes, plats that need a public decision, and development agreements. |
| Kyle Building and Fire | Building permits and fire code review inside the city, with the fire district. |
| City of Kyle Utilities and other providers | Kyle serves much of the city. Other utilities hold service areas nearby. The provider for the parcel decides capacity. |
| Hays County | Floodplain, septic and county roads on land outside the city limits, including much of the ETJ. |
| TCEQ | Edwards Aquifer rules where the parcel sits over the recharge or contributing zone. |
| TxDOT | Access and permits on I-35, its frontage roads and other state highways. |
The usual path
Approvals a typical project meets here.
A common order for a commercial or small multifamily project. Your parcel and plan can add or remove steps.
- 1
Confirm city, ETJ or county
City limits, ETJ, released land or county only. Check annexation history and any development agreement on the tract.
- 2
Zoning, inside the city
Is the use allowed by right? If not, a zoning change or conditional use goes to public hearing.
- 3
Plat or replat
Needed when the tract is not a platted lot, or when lots are combined or split. City or county, depending on location.
- 4
Utility service
Will-serve or service agreement, capacity and any line extension, and a fire flow answer.
- 5
Site plan
Layout, drainage, landscaping, access and parking reviewed against city standards.
- 6
Access
City driveway rules, or TxDOT on state roads. Traffic analysis scales with trip generation.
- 7
Building and fire permits
Plans reviewed for the building code and fire code edition the city has adopted.
What most often matters
The local constraints we check first.
City or ETJ
The answer sets whose rules apply. Annexations and releases move the line, and maps can lag.
Jurisdiction and ETJ guideDevelopment agreements
Kyle has many recorded development agreements. They can lock in rules, bind later owners and change the path.
Vesting guideWater quality
Parts of Kyle sit over the Edwards Aquifer, and the city has been working on new water quality rules. We flag pending changes.
Impervious cover guideAccess on I-35
Frontage road driveways need TxDOT. Spacing rules can mean one driveway in one place, or shared access.
Access guideWho serves the site
City service areas and neighboring providers meet in Kyle. The service area decides who you ask, and line maps can be years old.
Water and wastewater guidePlum Creek floodplain
Creeks through the city carry mapped floodplain. New FEMA maps for Hays County may change lines.
Floodplain guideGood to know
Things that catch people here.
General orientation, not advice for a specific site. Rules and maps change; confirm with the approving authority.
Annexation changes the rulebook mid-stream. Land can move from county to city. Texas law protects some existing uses on annexation, but not every rule, so the date and terms matter.
Releases from the ETJ need paper. Texas now lets many owners petition out of a city ETJ. Public maps do not always show it, so we ask for the release document before relying on it.
Pending rules. When the city is considering new water quality or development rules, we record them as pending and tell you how a project could be affected. Vesting rules may protect a project that applied first.
Fees come before permits. Impact and district fees can be due before a building permit. They belong in the budget early.
